Data processing and data transmission are carried out exclusively on the basis of legal regulations, in particular:

• for the purpose of carrying out application procedures under building law
• for the purpose of involving other municipal offices and specialist authorities whose opinions are required for processing the application
• for the purpose of neighbor participation (§ 55 LBO)
• for the fulfillment of tasks according to § 47 LBO as well as §§ 64 ff, 69, 71, 75 LBO and VwV Brandverhütungsschau (fire prevention inspection regulations)
• to fulfill our duty to advise according to § 25 LVwVfG
• to fulfill our duty to inform other authorities (e.g. data transfer to municipal offices, the district chimney sweep, the tax office, the State Statistical Office, the Employer's Liability Insurance Association, the Stuttgart Main Customs Office, the Stuttgart Regional Council as part of the appeal procedure)
• to authorities and organizations with security tasks for danger prevention
• in the case of certificates of self-contained units in accordance with the German Condominium Act (Wohnungseigentumsgesetz)
• the information on the building permit (§ 59 para. 1 LBO)
• the information within the scope of the execution of the heat laws (EWärmeG, EEWärmeG, EnEV)
• within the framework of the building inspection according to §§ 17 ff LBO.

The personal data are processed in the procedure for which they were collected.

All application data is processed in the building files in paper and electronic form. Since the building law processes must be traceable at all times, the files are kept permanently, at the longest until the building is demolished - and beyond in the case of an archiving obligation.

This also applies to the personal data of the author of the design, the creator of the declaration on the proof of stability or structural engineer (structural engineer), construction manager / specialist construction manager, operator of commercial facilities, demolition contractor, specialist planner, building contractor, specialist contractor as well as adjoining owners.

In the case of consulting services for which a fee is charged, the data will be stored until the fee notice becomes final or until the fee is paid.

After completion of a building law procedure, the municipal offices in particular have the opportunity to inspect files of completed procedures in order to perform their specific tasks.

The Building Law Office grants file inspection to the property owners or their authorized representatives as well as to persons who claim a legitimate interest (e.g. design drafters for projects on neighboring properties, students for the preparation of student theses). Rights to inspect files also result from § 29 LVwVfG and LIFG.
Any inspection of files is carried out at the due discretion and in compliance with the legal requirements.

You are obliged to provide the personal data required for the above-mentioned purposes. Failure to provide the data will mean that your application or the declaration you have made cannot be processed or that advice can only be provided to a limited extent.

You are not required to provide your telephone number, fax number or e-mail address. This information facilitates and speeds up the process of contacting you. If this information is missing, you can only be contacted in writing. This may lead to delays in processing.

As a data subject, you have the right to request information from the city about the processing of personal data (Art. 15 DSGVO), the correction of incorrect data (Art. 16 DSGVO), the deletion of data (Art. 17 DSGVO) and the restriction of processing (Art. 18 DSGVO), provided that the legal requirements for this are met.

You may lodge an objection in accordance with Art. 21 DSGVO.

You may revoke your consent to the processing of information provided voluntarily at any time. Without prejudice to other legal remedies, you may lodge a complaint with the State Commissioner for Data Protection and Freedom of Information, Postfach 10 29 32, 70025 Stuttgart,  poststellelfdi.bwlde.
