According to German law, your child should be given your changed surname or, from 01.05.2025 after divorce of the parents, a double name consisting of your changed name and the previous birth name. This double name will be combined with a hyphen (also without a hyphen if desired).
Prerequisites
You have chosen a married name. Your child under the age of 5 will receive this married name by law as their birth name. Your child who is older than 5 years of age can agree to your name change.
Or you have made a declaration that you wish to resume your name after the dissolution of the marriage. Your child can join your name change or have a double name consisting of the previous birth name and your re-adopted surname with a hyphen (or without a hyphen if you wish).
If the child previously had the surname of the other parent or if the other parent also has custody of the child, their consent is required to change the child's name.
Procedure
You can submit the name declaration at any German registry office. If you need an interpreter, please bring one with you to the appointment.
However, the declaration only becomes effective when it is received by the registry office that keeps the child's birth register. If the birth of the child is not recorded in a German birth register, your local registry office is responsible for the effective receipt of the declaration.
Only then can a certificate of the name change and, if requested, a new birth certificate be issued. With such a document, you can apply for a new identity document for your child.
Required documents
- Valid identity card or passport of the person(s) making the declaration
- Current original birth certificate or certified printout from the child's birth register (available from the registry office in whose district the child was born)
- current marriage certificate or certified printout from the marriage register in the original with a note of dissolution (available from the registry office where the marriage was concluded) or
- Marriage certificate or certified printout from the marriage register and legally binding divorce decree, each in the original
or
- Marriage certificate or certified printout from the marriage register and death certificate, both originals
Notes:
- If the birth or marriage took place at the registry office where the name declaration is to be submitted, the above documents are not required.
- In the case of marriage abroad, a birth certificate as well as a translation and legalization of the documents may be required.
- In the case of divorce abroad, a formal recognition procedure may be necessary.
- Further documents may also be required.
