You can also apply for the concession if you are not a physician. However, medical care must then be provided by employed specialists.

If you are not a physician who has the necessary specialist training to operate a clinic, you must prove that you can guarantee medical care when you submit your application.

After the application has been submitted, the involvement of specialist authorities, in particular the health authority, is required. The opinions of the specialist authorities are then incorporated into the conditions for the granting of the concession.

• Information on the purpose and name of the clinic, including information on the legal form of the clinic or the clinic owner, the predominant types of surgery and the planned start of operations
• Personal data of all applicants with address, date of birth and contact details (in the case of partnerships) or of the responsible partners (in the case of legal entities)
• in the case of companies: the shareholders' agreement and an excerpt from the commercial register, in each case in the current version
• Description of operation with information about functional rooms, especially operating and procedure rooms, number and distribution of patient beds, nursing staff (staff key, night and weekend duty), average length of stay, catering (own kitchen or caterer, for staff handling food, a briefing in accordance with § 43 of the Infection Protection Act is required), laundry cleaning (in-house or external) as well as the designation of the person responsible for the medical area, in particular for monitoring hygiene ("hygiene officer" including proof of further training) and a description of the medical on-call service outside the "operating hours".
• It must be explained how emergencies are dealt with (provision of emergency kit, ventilator, defibrillator, emergency laboratory (incl. location) and emergency power supply, as well as how clinic operations are to be maintained in the event of staff shortages).
• Submission of a hygiene concept including the responsible persons according to §§ 6 to 8 Ordinance on Hygiene and Infection Prevention in Medical Facilities
• Construction documents in accordance with § 2 Procedural Ordinance to the State Building Code, including a representation of the number of patient beds (single rooms, double rooms, multi-bed rooms and intensive care beds) and functional areas in the construction drawings
• in the case of clinic takeovers: Declaration that no or which structural changes have been or are to be made
• Ventilation concept for functional areas
• Disposal concept for accumulated hazardous waste
• Licensing certificates (or certified photocopy) of the medical director and his deputy, the heads of the departments, the anesthetist(s) and possibly proof of other relevant specialist licenses related to the purpose of the facility
• Certificate of good conduct (purpose of use: "GZ: 32-21.3" and "Permission according to § 30 GewO, private hospitals") for submission to an authority from all applicant(s) or managing director(s) (in the case of applicants without residence in the Federal Republic of Germany, but in another EU state, comparable proof of registration according to the state law of the EU state in which the applicant has his residence)
• extract from the commercial register of all applicant(s) or managing director(s) (in the case of applicants not domiciled in the Federal territory but domiciled in another state, application to the Federal Office of Justice). In the case of legal entities, information from the commercial central register on the legal entity is also required.
• Self-certification by applicant(s) or managing director(s) that no criminal proceedings are pending
• Certificate of the insolvency court that no insolvency proceedings have been opened against the assets of the applicant(s). In the case of legal entities, this applies accordingly to the sponsoring and operating company.

Please apply for the concession no later than two months before the planned start of operation. The application can be made informally. However, processing is only possible after all documents have been submitted.

• The framework conditions of the "Guideline for Hospital Hygiene and Infection Prevention" as well as the specifications on "Requirements for Operations and Other Invasive Procedures" and the "Appendix on Requirements for Outpatient Surgery in Hospitals and Practices" of the Robert Koch Institute must be observed, as well as the "Recommendation on the Scope of Capacity for the Care of Hospitals and Other Medical Facilities by Hospital Hygienists" and the "Hygiene Requirements for the Reprocessing of Medical Devices" of the Commission for Hospital Hygiene and Infection Prevention at the Robert Koch Institute.
• The "Krankenhaushygienische Leitlinie für die Planung, Ausführung und den Betrieb von Raumlufttechnischen Anlagen in Räumen des Gesundheitswesens" (Hospital Hygiene Guidelines for the Planning, Construction and Operation of Air Handling Systems in Health Care Facilities) of the "Deutsche Gesellschaft für Krankenhaushygiene" (German Society for Hospital Hygiene) must be observed with regard to the specifications contained for the respective rooms.
• In postoperative monitoring, the recommendation of the "German Society for Anesthesiology and Intensive Care Medicine and the Professional Association of German Anesthesiologists" on "Monitoring after anesthetic procedures" must be observed.
