Under German law, a married couple can
- the maiden name or
- the name of one of the spouses at the time of marriage
- from 01.05.2025 also a double name formed from the names of both spouses with a hyphen (if desired without a hyphen)
as the joint surname (= married name).
The determination of the married name is binding and cannot be reversed during the marriage.
The same applies to the use of a name in a registered civil partnership.
Prerequisites
The declaration can only be made jointly and personally by the spouses/partners.
Procedure
You can submit a name declaration at any German registry office. If you need an interpreter, please bring one with you to the appointment.
However, the declaration only becomes effective when it is received by the registry office that keeps your marriage register.
If your marriage was not notarized in a German marriage register, your local registry office is responsible for the effective receipt of the declaration.
Only then can a certificate of the name change and, if requested, a new marriage certificate be issued. With such a document, you can apply for a new identity document.

- Valid identity card or passport of both spouses
- Current marriage certificate or certified printout from the marriage register in the original
(available from the registry office where the marriage took place).
Note
- If the marriage was concluded at the registry office where the declaration on the use of name is to be submitted, the above-mentioned documents are not required.
- If the marriage took place abroad, a birth certificate as well as a translation and legalization of the documents may be required.
- Further documents may also be required.
