You would like to have a joint married name under foreign law.
If you are a foreign national and no marriage register is kept in Germany, please contact your local consulate.
The same applies to the use of names in a registered civil partnership.
Prerequisites
The declaration can only be made jointly and personally by the spouses.
Procedure
You can make a name declaration at any German registry office. However, the declaration only becomes effective when it is received by the registry office that keeps your marriage register. If your marriage is not recorded in a German marriage register, your local registry office is responsible for the effective receipt of the declaration. Only then can a certificate of the name change and, if requested, a new marriage certificate be issued. With such a document, you can apply for a new identity document.
Required documents
- Valid identity card or passport of both spouses
- Current marriage certificate or certified printout from the marriage register in the original
(available from the registry office where the marriage took place).
Note
- If the marriage was entered into at the registry office where the declaration on the use of name is to be submitted, the above-mentioned documents are not required.
- If the marriage took place abroad, a birth certificate as well as a translation and legalization of the documents may be required.
- Further documents may also be required.
