You are married and your child is to be given the name of the stepmother/stepfather in accordance with German law (= renaming).
Or:
Under German law, your child should no longer bear the name of the stepmother/stepfather (= renaming).
Prerequisites
In the case of renaming:
You are newly married and have taken your minor child into your joint household.
An adult child can make the declaration regardless of their place of residence with the consent of the parent and stepparent.
In the case of renaming:
Your marriage has been dissolved or the child leaves the joint household.
Procedure
You can make a name declaration at any German registry office and if you need an interpreter, please bring one with you to the appointment.
However, the declaration only becomes effective when it is received by the registry office that keeps your marriage register.
If your marriage was not notarized in a German marriage register, your local registry office is responsible for the effective receipt of the declaration.
Only then can a certificate of the name change and, if requested, a new marriage certificate be issued. With such a document, you can apply for a new identity document for your child.
Required documents
- Valid identity card or passport of the person(s) making the declaration
- Current original birth certificate or certified printout from the child's birth register (available from the registry office in whose district the child was born)
- Proof of custody of the minor child
- Proof of residence of the persons involved
- In the case of renaming, current original marriage certificate or certified printout from the marriage register (available from the registry office where the marriage took place)
- In the case of renaming, current marriage certificate or certified printout from the marriage register, if applicable with a note of dissolution or legally binding divorce decree in the original (available from the registry office where the marriage was concluded)
Notes:
- If the marriage was entered into at the registry office where the declaration on the use of name is to be submitted, the above-mentioned documents may not be required.
- In the case of marriage abroad, a birth certificate as well as a translation and over-certification of the documents may be necessary.
- In the case of divorce abroad, a formal recognition procedure may be necessary.
- Further documents may also be required.
