As the parent with sole custody, you can give your child the surname of the other parent in accordance with German law or, from 01.05.2025, a double name formed from your two surnames with a hyphen (also without a hyphen if desired).
Prerequisites
You have sole custody of the child and the child's other parent agrees to the name being given.
Procedure
You can submit a name declaration at any German registry office. If you need an interpreter, please bring him/her with you to the appointment.
However, the declaration only becomes effective when it is received by the registry office that keeps the child's birth register.
If the birth of the child is not recorded in a German birth register, your local registry office is responsible for the effective receipt of the declaration.
Only then can a certificate of the name change and, if requested, a new birth certificate be issued. With such a document, you can apply for a new identity document for your child.
Required documents
- Valid identity card or passport of the person(s) making the declaration
- Current original birth certificate or certified copy from the child's birth register (available from the registry office in whose district the child was born)
- Acknowledgment of paternity, if applicable
- Birth certificate or certified copy from the birth register of the person giving the name (available from the registry office in whose district the person was born)
- Proof of sole custody
Notes:
- If the birth was notarized at the registry office where the name declaration is to be submitted, some of the above documents are not required.
- In the case of births abroad, a translation and over-certification of the documents may be necessary.
- Further documents may also be required.
Making an appointment
You can make an appointment online (opens in a new tab) at the Stuttgart registry office if you got married in Stuttgart city center, if your child was born in Stuttgart city center or if you live in Stuttgart city center.
