If joint custody is subsequently established (= if the child already has a birth name) through marriage or a declaration to the youth welfare office, the child's birth name can be redetermined.
Prerequisites
They have joint custody and do not have a married name.
Procedure
You can submit a name declaration at any German registry office. If you need an interpreter, please bring him/her with you to the appointment.
However, the declaration only becomes effective when it is received by the registry office that keeps the child's birth register.
If the birth of the child is not recorded in a German birth register, your local registry office is responsible for the effective receipt of the declaration.
Only then can a certificate of the name change and, if requested, a new birth certificate be issued. With such a document, you can apply for a new identity document for your child.
Required documents
- Valid identity card or passport of both parents
- Current original birth certificate or certified printout from the child's birth register (available from the registry office in whose district the child was born)
- If you are married: marriage certificate or certified printout from the marriage register (available from the registry office where you got married)
- If you are not married: proof of joint custody and, if applicable, acknowledgement of paternity and birth certificate or certified printout from the father's birth register (available from the registry office in whose district the father was born).
Notes
- If the birth or marriage was recorded at the registry office where the declaration on the use of name is to be submitted, the above-mentioned documents are sometimes not required.
- In the case of births abroad, a translation and over-certification of the documents may be necessary.
- Further documents may also be required.
