Outdoor catering on private land
If the outdoor catering of a restaurant is located on private land, the outdoor catering is granted with the necessary restaurant license, provided that a building permit has been obtained for this purpose. This means that it is a one-time permit.
Outdoor catering on public traffic areas
General requirements:
If a public traffic area is to be used for outdoor catering, a permit under special use and catering law must be applied for for the period of outdoor catering.
A formal procedure is required for this purpose, during which it is checked whether there are any public-law concerns that conflict with the permit. In particular, escape and rescue routes, fire lanes, supply facilities and fire department ladder areas must not be impaired.
If there are no objections to outdoor management, it is approved for a period of up to one year.
Additional requirements for street businesses on sidewalks, in pedestrian areas and on squares:
- Residual sidewalk width 2.50 m on school paths, otherwise 2.00 m in other areas.
- The area must be in direct spatial connection with the restaurant.
Additional requirements for street restaurants in parking lots:
- The parking spaces must be located in front of the restaurant
- A barrier must be installed to the roadway
- The operator of the restaurant is responsible for traffic safety and winter road maintenance.
- No street bars are permitted
- on special parking spaces, e.g. parking spaces for severely disabled persons, car sharing, or cabs
- on short-term parking spaces, i.e. parking spaces with a very short parking time, are not available
- next to structural bike lanes, 5 m. in front of and behind crosswalks or street junctions.
Note: You must submit the application annually.
Extension request
The procedure is shortened for renewal applications. Unless there are findings contrary to outdoor management, the extension will be granted.
Fee:
A fee is charged for the permit. This fee is based on the size, duration and location of the outdoor use.
