If you are the father of an illegitimate child, you can acknowledge your paternity. This must be publicly notarized, and the mother's personal consent is required. You can have paternity acknowledged at the registry office, at the youth welfare office and at all notaries.
Note: Declarations of joint parental care cannot be notarized at the registry office; the Youth Welfare Office is responsible for this. If you acknowledge paternity at the Youth Welfare Office, you can make a declaration on custody at the same time.
Note: You can have paternity notarized before the birth.
Prerequisites
All parties involved must be present in person.
Procedure
You must declare the acknowledgement of paternity to an employee of the competent body that is authorized to issue public documents.
Note: The father and the mother of your child can declare the acknowledgement of paternity and consent together or separately.
The employee of the competent office will summarize your declaration and consents in a public document. You will receive a certified copy of it.
If you have already acknowledged paternity before birth, your name will be entered on the birth certificate. If you have acknowledged paternity after the birth, the registry office at the child's place of birth will issue a new birth certificate.
Required documents
For the declaration of the father:
- Father's identity card or passport
- before birth: proof of the child's expected date of birth
- after birth: birth certificate of the child.
- Mother's identity card or passport
- if the consent is given separately from the recognition: certified copy of the father's declaration of recognition
- before birth: proof of the expected date of birth of the child
- after birth: birth certificate of the child
- for other declarations of consent (e.g. from legal representatives of a minor parent): Identity card or passport of the consenting persons and, if applicable, proof of status as legal representative of the minor parent (e.g., judicial transfer of custody).
The birth certificates of the parents must be presented at the registry office after the birth of the child.
Deadlines
Paternity can be acknowledged at any time, even before the birth of the child.

Please make an appointment in good time by calling the Youth Welfare Office or your local registry office, as there may be longer waiting times due to high demand.

You can reverse the acknowledgement of paternity if it has not become effective one year after it was notarized. This is the case, for example, if the child's mother has not agreed to the recognition for one year.
