With the new right of residence for opportunities in accordance with Section 104c AufenthG, people who have been living in Germany for five years on 31.10.2022 with a tolerated or permitted status or with a residence permit will receive an 18-month right of residence for opportunities in order to meet the further requirements for a right of residence in accordance with Section 25a (residence permit for well-integrated young people and young adults) or Section 25b AufenthG (residence permit for sustainable integration) during this time.
Please note that it is not possible to switch from the right of residence for opportunities to a residence title other than § 25a or § 25b AufenthG. You must therefore meet the requirements for a residence permit under § 25a or § 25b AufenthG after 18 months at the latest.
Applying for a residence permit in accordance with § 104c AufenthG does not initially change your residence status or your tolerated stay.
