According to §195 (3) BauGB in connection with §13 GuAVO, corresponding information from the purchase price collection is provided upon written request. According to the law, three conditions must be met:
1. recipients must demonstrate a justified interest in knowing the data.
2. the information is not contrary to the overriding interests of the persons concerned that are worthy of protection.
3. the appropriate use of the data appears to be guaranteed.
The legitimate interest exists in the case of authorities and public bodies within the framework of the performance of their statutory duties as well as in the case of experts who are involved in the valuation of real estate. The information is always provided in anonymous form and may only be used for the purpose for which it was provided.
Comparative value and statement method
Depending on the type of property, the office of the expert committee offers appraisers information in the form of comparative value or extract procedures.
In the comparative value procedure, up to 30 most suitable comparative cases are selected and the purchase prices of these comparative properties are converted to the property to be valued using a standardized statistical evaluation procedure based on regression calculations. This model is available for residential property as well as for single-family houses, terraced houses and two/three-family houses, provided that the valuation date is within the last three to four years. For other properties and for dates further back in time, the selection of purchase cases is made according to agreed criteria and extracts from the purchase price collection are provided.
